These Terms of Use ("Terms") govern your use of the Temcrypta messaging service ("Service"). By using Temcrypta, you agree to these Terms.

1. Acceptance of Terms

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

2. Description of Service

Temcrypta is an end-to-end encrypted messaging platform that allows secure communication between users. The Service includes:

• End-to-end encrypted individual and group messaging
• Key management tools for security
• Account management features

3. User Registration and Account Security

To use Temcrypta, you must:

• Register with a username and password
• Keep your login credentials and private encryption keys secure
• Take responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

We strongly recommend exporting and safely storing your private keys, as we cannot recover your encrypted messages if you lose access to your keys.

4. User Obligations

When using Temcrypta, you agree to:

• Comply with all applicable laws and regulations
• Not use the Service for illegal purposes or to promote illegal activities
• Not attempt to gain unauthorized access to the Service or other users' accounts
• Not interfere with or disrupt the Service or servers
• Not harvest or collect user information without consent

5. Content and Conduct

You are solely responsible for the content of your communications through our Service. While we cannot access the content of your encrypted messages, you agree not to use our Service for:

• Unlawful, harmful, threatening, abusive, or harassing activities
• Distribution of malware or harmful code
• Fraudulent, deceptive, or misleading activities
• Content that infringes on intellectual property rights
• Content that violates any person's rights or privacy

6. Intellectual Property Rights

Temcrypta is open source software. The code is available on GitHub under the applicable open source license. You may review, contribute to, or fork the code according to that license.

The Temcrypta name, logo, and design elements are proprietary and may not be used without permission.

7. Privacy and Data Protection

Our handling of your personal data is governed by our Privacy Policy. By using Temcrypta, you consent to our privacy practices as outlined in that policy.

8. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to a breach of the Terms.

You may delete your account at any time through your profile settings. Upon deletion, your personal data and messages will be permanently removed from our systems.

9. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind
• We shall not be liable for any indirect, incidental, special, consequential or punitive damages resulting from your use of or inability to use the Service
• We shall not be responsible for any loss of data, including encryption keys that you have not properly backed up

10. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of significant changes through the Service or by other means. By continuing to use the Service after such changes, you agree to be bound by the updated Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the European Union and your country of residence, without regard to its conflict of law provisions.
